These Terms and Conditions ("Terms") govern your use of www.thefifthdesign.com.au and any purchase you make from us. The website and our products are operated by The Fifth Design Pty Ltd (ABN 46 364 975 151), based on the Sunshine Coast, Queensland.

By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use our site or order from us.

Our products.

Every Fifth Design piece is handcrafted using resin and natural timber, primarily Camphor Laurel. Because each piece is made by hand and the resin flows differently every pour, the items you receive will vary slightly from the photos and from each other in colour, grain, resin pattern and finish. These variations are part of what makes each piece unique and are not considered defects.

Photography on our website is a guide only. Lighting, monitors and natural variation mean colours may differ slightly from screen to product.

Using your board with food.

The resin areas on our boards and homewares are decorative features. Our epoxy resin is ASTM-D 4236 certified, which means it is technically safe for incidental food contact with dry foods. For best results, and to keep the resin finish beautiful for years, we recommend serving and chopping on the timber portion of the board, and using the resin side for serving items like dip bowls, olive bowls and soft cheeses (with parchment paper underneath if needed).

Do not cut directly on the resin, and do not place hot pans or food straight from the oven on the resin (use a trivet). The Fifth Design is not responsible for damage or illness resulting from misuse of the product. For full use and care guidance, see our care guide.

Pricing and currency.

• All prices are in Australian dollars (AUD).
• Prices for orders shipped within Australia include GST.
• International orders are GST-free. Local import duties, taxes and charges are the responsibility of the recipient.
• We may change prices at any time. The price applied to your order is the one shown at the time of checkout.

Orders and acceptance.

Placing an order is an offer to buy. Your order is accepted when we send you an order confirmation email. We may refuse or cancel an order before it is fulfilled if:

• An item is out of stock or unavailable
• A pricing or product description error has occurred
• We suspect fraud or unauthorised use of payment
• Your delivery address falls outside our serviceable areas

If we cancel an order you have paid for, we refund the full amount to your original payment method.

Payment.

We accept payment through the methods displayed at checkout, including credit and debit cards, Shop Pay, PayPal, Afterpay and others. Card details are processed by our payment providers and not stored by us.

Shipping and delivery.

Shipping options, rates and estimated transit times are explained on our shipping page. Delivery dates are estimates only and are not guaranteed by us or Australia Post. Title and risk in the goods pass to you when the carrier collects the parcel from our studio.

Engraving and personalisation.

Personalised and engraved items are made to your specifications. Please double-check spelling, punctuation, layout and wording at checkout. We engrave exactly what is provided. We are not responsible for typographical errors in the text you supply.

Engraved items cannot be returned or exchanged for change of mind. Defects, errors on our part, or major failures are covered by our returns policy and your statutory consumer guarantees.

Returns and exchanges.

Intellectual property.

All content on our website, including text, photography, graphics, logos, designs and the look and feel of our products, is owned by The Fifth Design Pty Ltd or our licensors and is protected by Australian and international intellectual property laws. You may not copy, reproduce, modify, distribute or commercially use any of this content without our prior written permission.

Our trademarks, including "The Fifth Design" wordmark and logo, may not be used without our written permission.

User content.

If you submit photos, reviews, comments or other content (for example, by tagging us on Instagram or submitting a product review), you grant The Fifth Design a worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish and distribute that content for marketing and operational purposes. You confirm that the content is yours to share and does not infringe anyone else's rights.

Website use.

You may use our website only for lawful purposes. You must not:

• Use the site in any way that breaches Australian law
• Attempt to gain unauthorised access to our systems or accounts
• Introduce malware, viruses or harmful code
• Scrape, copy or reverse-engineer the site or its content
• Impersonate another person or misrepresent your identity

Disclaimers.

We provide our website on an "as is" and "as available" basis. We do our best to keep it accurate and operational, but we do not guarantee uninterrupted access or error-free content.

Subject to your rights under the ACL, our liability for any loss or damage in connection with our products or website is limited to, at our option, the cost of replacing the product, the cost of supplying an equivalent product, or refunding the purchase price.

Privacy.

Your personal information is handled in line with our Privacy Policy. By placing an order or using the site, you consent to that policy.

Governing law.

These Terms are governed by the laws of the State of Queensland, Australia. You and we both submit to the non-exclusive jurisdiction of the courts of Queensland.

Changes to these Terms.

We may update these Terms from time to time. Updates take effect when posted on this page. Orders placed before a change are governed by the Terms in force at the time of the order. Continuing to use our site after a change means you accept the updated Terms.
